  • If the "Ground and Air Packaging Provisions Exceptions" column of the chemical table references a specific packaging exception, refer to that section of 49 CFR to determine if your material qualifies for the exception. If you do not meet all the conditions for that exception, you must prepare the material under the rules for a fully regulated hazardous material.

    The material used in this marking example is Chromic Acid Solution, 8, UN1755, PGII. Using this as an example, the DOT regulations allow this material to be shipped as a limited quantity item if it meets the conditions of 49 CFR 173.154 -- that is, non-specification outer packaging is permitted if inner receptacles do not exceed a capacity of 1 L. If any of your inner receptacles exceeds the 1 L capacity, your shipment is ineligible for this exception.

    Further, since this shipment is not being transported by aircraft, you may ship the package without a hazard label. The limited quantity marking depicted below indicates that you have classified your material under HM-215K and that your package is excepted from the specification packaging and labeling requirements.

    Most limited quantity shipments prepared under HM-215K are eligible to be shipped via ground service in the 48 contiguous states without shipping papers or Shipper's Certifications. It is the shipper's responsibility to properly classify, package, label and mark their materials in conjunction with current regulatory requirements.

    Even though your packaging need not be a UN performance package, it must meet the requirements of 49 CFR 173.24 and 173.24(a) and must be capable of meeting the ISTA Procedure 3A test.
